Rental Agreement Between ____, Hereinafter Termed "Renter", & , Hereinafter Termed "Owner”, Related to , termed Premises.
- Role of Finger Lakes Getaways, Finger Lakes Getaways has been hired by owner as its Agent in securing rentals on its premises. Commissions for rental services provided are negotiable between owner and agent. Finger Lakes Getaways, has met all its obligations to owner & renter when placement of rental is finalized with signature on this contract & owner acceptance of same.
- Parties to Rental Agreement: are Renter & Owner & both parties agree to all terms & conditions of this contract.
- Premises consist of dwelling, contents, and its lot & is to be used for usual residential & recreational purposes associated with a vacation dwelling & for no other purpose. Renter accepts Premises "AS IS" & acknowledges this agreement & its attachments, if any provided sufficient description of premises as stated by owner. No oral or other descriptions of premises are required or represented or valid other than provided here.
- Dates of Rental: Rental period begins on ______ & ends on ____. Renter may enter Premises at 3 PM on starting date. Renter must exit Premises by 10 AM on ending date. (Check in and check out times are FIRM!). Special arrangements to accommodate renter carry a fee to Finger Lakes Getaways of $30 Per hour.
- Key(s) To Rental:
- Standard procedure: Key must be picked up from Finger Lakes Getaways offices on check in date near entry time. Keys Must be returned to Finger Lakes Getaways Offices at checkout. If you will be arriving after normal office hours, your keys will be in the lockbox next to our back door, in a manila envelope with your name on it. The lockbox combination is 0-0-0.
- Loss of keys or Non-Return of Keys: result in Renter incurring a $30 fine and charge for new lock and keys to premises at $35. Per man hour plus materials.
- Iif someone other than individual signing this contract needs to pick up the keys or be given access: We must receive this in writing with person's full legal name & relationship to you. That individual MUST be prepared to provide their driver's License as proof of identification BEFORE given key or access.
- PAYMENT OF MONIES:
- To secure this rental, there is a non-refundable reservation fee of 9% of the total rent, ($50 minimum fee). This must be paid by credit card at the time that the owner of the property approves your booking. Method of payment: Checks and Money Orders must be made payable to Finger Lakes Getaways. Where time is of the essence in your booking, please OVERNIGHT to Finger Lakes Getaways, 219 LAKE ST, PENN YAN, NY 14527.

- Signed contract MUST be received with initial payment. Where time is of the essence to secure your booking, Fax signed contract to 315-536-4720 or overnight to Finger Lakes Getaways 219 Lake St, Penn Yan, NY 14527. There is no rental without signed contract & payment of monies as scheduled.
- DEPOSITS:
-Damage deposit being charged is held in non-interest bearing escrow account until your exit from the rental, which will be inspected & should have NO damage to interior or exterior Premises & be clean. Damage deposit will be refunded in full within 45 days of exit unless warranted deductions must be made which will be documented in writing to you.
-Pet Fee is collected if you have been approved to have pets at your rental. There is to be NO sign of a pet on interior or exterior property at your exit. If bringing a pet, see attached pet addendum. Any problems with the pet during or subsequent to your rental will be documented & warranted deduction made from your damage deposit.
-Telephone: You must use calling card or call collect when making long distance phone calls. If you use any access via property phone to access or use internet, any charges on owner’s bill will be passed to renter and become renter’s responsibility to pay. Any/all phone charges incurred during your stay are the responsibility of renter and WILL be billed to renter PLUS a $15 handling fee.
- Returned or "Bounced" checks carry a $40. Fee to be paid to Finger Lakes Getaways for each & every incident plus bank fees or charges. FULL AMOUNT OF INSUFFICIENT CHECK AND $40 FEE & BANK CHARGES MUST BE PAID TO Finger Lakes Getaways by money order or cashier's check within three days of renter being notified. If this is not met as specified, returned check will be presented to law enforcement agency for collection & any fees, time, etc., involved to collect monies will be paid by renter.
- Cancellations, Refunds, Re-Rentals:
- Cancellations by renter & refunds: If renter is unable to or chooses not to occupy Premises during contracted rental period, NO return of rent or deposits or portion thereof will occur except upon ALL conditions being met as follows: 1-Renter advises Finger Lakes Getaways in writing, three weeks minimum prior to beginning of rental period that renter will not be using premises for all or specific portion of contracted rental period. 2- Renter, in writing, advises Finger Lakes Getaways to attempt to re-rent premises during rental period or specific portion thereof. 3- Premises are re-rented for part or all of rental period for which monies were paid.
Note: Although 3 week written notice is required on cancellations, on renter emergencies causing them to be unable to utilize their Rental, Finger Lakes Getaways will exert every effort with formal request in writing to re-rent any or all of rental period renter is forced to cancel. Same terms & conditions noted in Ixa&b apply.
IXb- Re-Rentals: If Finger Lakes Getaways succeeds in re-renting premises following renter meeting terms stated in Ixa portion of this agreement, rental monies shall be refunded to renter upon receipt of Finger lakes Getaways service charge of fifteen percent (15%) of the re-rental amount or $75.00 whichever is greater. If renter has not paid entire monies for contracted rental period when cancellation notice and request to re-rent is given, any refunds received for re-rental of Premises shall first be applied to period for which no monies were paid which Renter owed regardless of actual dates of re-rental. If Premises is unable to be re-rented for period canceled by renter or longer than period for which no monies were paid; no part of rental monies shall be returned to renter.
NOTE: On any re-rental vacancy periods which are unable to be refilled and are paid for by renter, both owner and renter acknowledge the rental must be left vacant by anyone other than renter to occupy at will.
- SPECIFICS TO PROPERTY:
- Owner provides for Renter furnished dwelling with use of working electric service, stove, refrigerator, & basic household items.
- Linens- It is specifically understood unless otherwise stated Owner does NOT provide bed linens, towels, washcloths. There are blankets/bedcovers and pillows available for Renter use.
NOTE: Renter MUST provide their own bed linens, towels, washcloths OR Connect-A-Service to arrange for these in advance of rental, by separate agreement. If renting linens, please leave neatly bagged & tied near entry door at exit for pickup.
- Owner provided items categorized as "luxury or supplemental" ie; washer/dryer, dishwasher, hot tub, cable/internet etc: It is discretion of Renter to use these items or not; Owner is under no obligation to repair or replace these items should they become unusable and Owner is held harmless regarding same.
- Off limits to renters, guests and invites:
This is to be adhered to strictly.
- Trash disposal: Instructions for handling trash you accumulate are in the attached property information.
- LIMITATIONS AT RENTAL
- Overnight: no more than adults and children combined including renter.
- Morning to night: no more than adults and children combined including renter.
- Vehicles and parking: No more than vehicles, including those belonging to renter.
NO vehicles larger than pickup truck, no unlicensed vehicles, no motorcycles, no campers or tents!.
Parking area consists of
- NO smoking is permitted in interior Premises at any time.
- No disturbance to neighbors, adjoining properties or general area.
- Owner is providing furnished dwelling. Owner belongings may be used in careful manner by renter who agrees not to cause or allow to be caused any damaged by renter, guests or invitees, damage will be assumed by and immediately reported to Finger Lakes Getaways. If damage at any time in part or full exceeds damage deposit amount, renter agrees to remit payment for excess upon written notification including labor and materials. Failure to report obvious damage will be noted to owner for direction in handling upon discovery. Note: Owner belongings are to be kept in place and not rearranged or moved by renter, or guests. No cutting, trimming or breaking of Owner trees, limbs, bushes, plants by renter, guests or invitees is allowed.
- Beach fires are not permitted unless stated in attached property information as to specific locale and premises and following stated instructions.
- Renter belongings and/or those of renter guests left at premises at time of vacating are considered to be held by owner or owner's designee (S) as to storage, care or protection of said items. If renter recovered items returned to renter, it is up to renter to hire handling, mailing and /or delivering to renter including time and materials and cost of such handling and/or delivery. Renter will use premises at all times to ensure safety of renter, other occupants and/or guests permitted in this agreement.
- LIABILITY: This Lease agreement is made on the express condition that the owner shall be free from all liability and claims for damages by reason of injuries of any kind to any person, including renter and invitees or any property of any kind whatever and to whomever belonging, including renter, from any cause or causes while in, upon, or in any way connected with the premises during the term of this Lease Agreement or any extension of or occupancy under it. Renter Hereby agrees to save and hold harmless owner from any liability, loss, cost or obligation on account of or arising out of any such injuries or losses however occurring. Owner shall not be responsible for theft or damage, on the premises, if any to renters property caused by fire, water or from any cause whatever. Renter acknowledges need for extra care and precautions due to the lake front nature of the premises and recognizes and acknowledges, additionally, their own responsibility for any liability for the use or misuse of any boats, water sport equipment or any other items that they bring to the premises in connection with this rental.
- Possession of Rental: If Renter is unable to take possession of premises for contracted rental period due to Owner not having said Premises substantially ready for habitation. Renter will look solely to Owner. This will be handled & resolved between Renter and Owner with no responsibility or liability held by Finger Lakes Getaways.
- Inspections of Rental: Owner or Owner's designee may inspect Premises at any time Renter is reported to be in violation of any portion of this agreement & in case of emergency. Prior notification will be gained from renter at other times to show or inspect. If Renter does not adhere to all terms & conditions of this Agreement before & during contracted rental period, owner or Owner designee may cancel this rental by written notice to Renter. If Renter is occupying Premises at time of violation of this contract, Renter agrees to immediately vacate said premises when found to be in violation by either written or verbal notice & further to be subject to summary eviction proceedings.
- In Taking Premises "AS IS", Renter agrees this includes cleanliness, condition of Owner provided furnishings & belongings being acceptable. Lakefront & lake are accepted as varying in size & depth respectively according to weather conditions affecting water levels. Weather conditions & other "acts of gods" are not the responsibility of Owner or Owner Agent. RENTER MUST REPORT ANY UNSATIFACTORY CONDITIONS WITHIN ONE HOUR OF ENTRY TO OWNER AGENT FOR DOCUMENTATION & REFERENCE TO OWNER. RENTER AGREES TO BE HELD FINANCIALLY RESPONSIBLE FOR ANY UNREPORTED DAMAGES.
- EMERGENCIES;
- In case of Emergency, notify Finger Lakes Getaways at 315-536-4821, unless owner has provided emergency contact information for you. WHEN YOU CALL, YOU MUST LEAVE SPECIFIC MESSAGE, PHONE NUMBER, WHICH PROPERTY YOU ARE AT, WHAT THE PROBLEM IS AND TIME, OR THIS WILL NOT BE CONSIDERED AN EMERGENCY. Renter must report any broken, damaged or malfunctioning items to Owner Agent immediately for handling that occur subsequent to entry and prior to exit.
- DO NOT perform or have performed any work of any kind at the property. Renter will be subject to payment for same as well as possible cost of Owner to restore Premises to original condition.
- Dangerous or Potentially Dangerous Situation should be reported immediately Day or Night. Should such items not be reported, Renter could be responsible in event of any mishap of any nature resultant to person(s) &/or property from non-reporting of said condition & will indemnify & hold Owner harmless.
- Non-Emergent items needing repair or attention, which are not considered dangerous & do not present safety hazard, should be reported as such to be dealt with accordingly. If Renter is unsure whether situation is dangerous or not, follow emergency suggestions.
- Assigned Numeral & Descriptive Headings are used herein for convenience only and are NOT intended to include or conclusively define all of subject matter in paragraph accompanying such headings should not be resorted to for sole interpretation of this Agreement. THIS agreement stands as stated. In event any term, provision, Paragraph or article of this Agreement is declared illegal, void, or unenforceable, same shall not affect or impair other terms, provisions, paragraphs or articles in this Agreement. Doctrine of severability shall be applied. Parties do not intend by this statement to imply illegally or unenforceability of any term, provision, paragraph or article of this agreement.
XX - Contract Obligation:
Contract must be signed by responsible parties over twenty-one (21) & may not be assigned or sublet to any one other than enter(s) listed for signature at end of this agreement. Renter must present supportive identification for ensurance of identity of Person(s) picking up key for entry being same as Renter(s) signing this contract.
- NO REPRESENTATIONS ARE MADE AS TO QUALITY OF SAID WATER AND WE RECOMMEND THAT YOU BRING YOUR OWN DRINKING WATER AND ICE. PLEASE RESPECT AND DO NOT ABUSE OR OVER RUN THE TOILETS, SINKS, OR BATHING FACILITIES, ONLY HUMAN WASTE SHOULD BE PUT INTO TOILETS. ANY ACTUAL OR SUSPECTED PROBLEM WITH PLUMBING, CALL FINGER LAKES GETAWAYS AT 315-536-4821, IMMEDIATELY.
