General Vacation Rental Agreement



DATES OF RENTAL: Rental period begins on arrival date at 3 PM & ends on departure date at 10 AM, (these times are firm!).

KEYS TO RENTAL: Details will be sent to you before your arrival with how to enter the home and driving directions.

PAYMENT OF MONIES: To book this rental, there was a non-refundable reservation fee charged, (min $50). This is an administrative fee and is not applied to the rent.

METHODS OF RENTAL PAYMENT: Credit Card, Personal check or e-Check, Cashier’s Check or Money Order. Make payable to Finger Lakes Getaways.

PREMISES CONSISTS OF: dwelling, contents, and its lot and is to be used for usual residential and recreational purposes associated with a vacation dwelling and for no other purpose. Renter accepts Premises “AS IS”, acknowledges this agreement and its attachments, if any provided, sufficient description of premises as stated by owner. No oral or other descriptions of premises are required or represented or valid other than provided here.

SPECIFICS TO PROPERTY: Owner provides for Renter furnished dwelling with use of working electric service, stove, refrigerator, and basic household items. Regarding any owner provided “luxury or supplemental” items, Owner is under no obligation to repair or replace these items should they become unusable and Owner is held harmless regarding same. “Luxury items include, but are not limited to hot tubs, hot tubs, fireplaces, fire pits, canoes, kayaks, rowboats, paddle boats, life jackets, floating swim rafts, charcoal or gas grills, (replacement of propane tank/charcoal is renter’s responsibility unless otherwise noted), washer/dryers, dishwashers, cable, DVD/VCR or internet.

LINENS: It is specifically understood, owner does NOT provide bed linens, towels, washcloths, unless otherwise noted in property description. There are blankets/bed covers and pillows available for Renter use. NOTE: Renter MUST provide their own bed linens, towels, washcloths OR arrange for linen services. Lines services are provided by a rental company and arrangements must be made to provide these in advance of rental, by separate agreement. If renting linens, please leave neatly bagged and tied near entry door at exit for pickup.

TENANT: is responsible for all costs incurred to retrieve left behind items.

CSA DAMAGE INSURANCE: This plan protects you from accidental damage or a theft within the unit up to $3,000. You must notify Finger Lakes Getaways of any damage or theft to the unit during your occupancy. Purchasing the plan in lieu of a Security Deposit does not negate your responsibility as a tenant. Your rental must be clean upon your exit. Your vacation home is cleaned and inspected prior to your arrival and after you leave. There is no additional fee for this service. GUESTS, HOWEVER, ARE RESPONSIBLE FOR REASONABLE CLEANLINESS. THERE IS TO BE NO FOOD LEFT BEHIND, FLOOR SHOULD BE BROOM CLEAN AND TRASH MUST BE PROPERLY DISPOSED OF. YOUR CREDIT CARD WILL BE CHARGED FOR ANY EXCESSIVE CLEANING NEEDED, DAMAGES EXCEEDING INSURANCE COVERAGE OR TRASH EXCEEDING THE RECEPTACLES. All units are carefully inspected after each rental. Please refer to the enclosed plan information detailing terms, conditions and responsibilities of the tenant. This Rental Unit Damage Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000. Certain terms and conditions apply. Full details of the Rental Unit Damage Protection coverage are contained in the Certificate of Insurance or Insurance Policy. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Finger Lakes Getaways any amount payable under the terms and conditions of the Rental Unit Damage Protection.

CSA VACATION RENTAL TRAVEL INSURANCE: CSA Vacation Rental Insurance has been included with your reservation and will be a part of your initial deposit payment. Vacation Rental Insurance reimburses for prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. However, if you do not wish to purchase travel insurance, please sign below. By signing below, you acknowledge you have read and understand our cancellation policy and choose not to purchase Vacation Rental Insurance.

CANCELLATIONS, REFUNDS, RE-RENTALS: Cancellations by renter and refunds: If renter is unable to or chooses not to occupy Premises during contracted rental period, NO return of rent, fees or portion thereof will occur except upon ALL conditions being met as follows:
1-Renter advises Finger Lakes Getaways in writing, 60 days minimum prior to beginning of rental period that renter will not be using premises for all or specific portion of contracted rental period.
2- Renter, in writing, advises Finger Lakes Getaways to attempt to re-rent premises during rental period or specific portion thereof.
3- Premises are re-rented for part or all of rental period for which monies were paid.

RE-RENTALS: If Finger Lakes Getaways succeeds in re-renting premises following renter meeting terms stated in portion of this agreement, rental monies shall be refunded to renter minus Finger Lakes Getaways nonrefundable reservation fee or $75.00 whichever is greater. Any re-rental vacancy periods which are unable to be filled and are paid for by renter, both owner and renter acknowledge the rental must be left vacant by anyone other than renter to occupy at will.

ROLE OF FINGER LAKES GETAWAYS: Finger Lakes Getaways has been hired by owner as its Agent in securing rentals on its premises. Finger Lakes Getaways, has met all obligations to owner and renter when placement of rental is finalized with signature on this contract and owner acceptance of same. Parties to Rental Agreement are Renter and Owner and both parties agree to all terms and conditions of this contract.
In Taking Premises “AS IS”, Renter agrees this includes cleanliness, condition of Owner provided furnishings and belongings being acceptable. Lakefront and lake are accepted as varying in size and depth respectively according to weather conditions affecting water levels. Weather conditions and other “acts of gods” are not the responsibility of Owner or Owner Agent. RENTER MUST REPORT ANY UNSATIFACTORY CONDITIONS WITHIN ONE HOUR OF ENTRY TO OWNER AGENT FOR DOCUMENTATION and REFERENCE TO OWNER. RENTER AGREES TO BE HELD FINANCIALLY RESPONSIBLE FOR ANY UNREPORTED DAMAGES.

RETURNED OR “BOUNCED” CHECKS: carry a $20 Fee to be paid to Finger Lakes Getaways for each and every incident plus bank fees or charges. FULL AMOUNT OF INSUFFICIENT CHECK, $20 FEE and BANK CHARGES MUST BE PAID TO Finger Lakes Getaways by money order or cashier’s check within three days of renter being notified. If this is not met as specified, returned check will be presented to law enforcement agency for collection and any fees, time, etc., involved to collect monies will be paid by renter.
Possession of Rental: If Renter is unable to take possession of premises for contracted rental period due to Owner not having said Premises substantially ready for habitation, Renter will look solely to Owner. This will be handled and resolved between Renter and Owner with no responsibility or liability held by Finger Lakes Getaways.

EMERGENCIES: In case of Emergency, notify Finger Lakes Getaways at 315-536-4821, unless owner has provided emergency contact information for you. When you call, you must leave specific message, phone number, which property you are at, what the problem is and time, or this will not be considered an emergency. If after business hours, please contact emergency number given on office voicemail recording. Renter must report any broken, damaged or malfunctioning items to Owner Agent.

NON-EMERGENT ITEMS NEEDING REPAIR OR ATTENTION (WHICH ARE NOT CONSIDERED DANGEROUS AND DO NOT PRESENT A SAFTEY HAZARD: should be reported as such to be dealt with accordingly. If Renter is unsure whether situation is dangerous or not, follow emergency suggestions.

CONTRACT OBLIGATION: Contract must be signed by responsible parties over twenty-one (21) and may not be assigned or sublet to anyone other than Renter(s) listed for signature at end of this agreement.

THIS AGREEMENT STANDS AS STATED: In event any term, provision or paragraph of this Agreement is declared illegal, void, or unenforceable, same shall not affect or impair other terms, provisions or paragraphs in this Agreement. Doctrine of severability shall be applied. Parties do not intend by this statement to imply illegally or unenforceability of any term, provision or paragraph of this agreement.

BREACH OF CONTRACT: Owner or Owner’s designee may inspect Premises at any time Renter is reported to be in violation of any portion of this agreement and in case of emergency. If Renter does not adhere to all terms and conditions of this Agreement before and during contracted rental period, Owner or Owner designee may cancel this rental by written or verbal notice to Renter. If Renter is occupying Premises at time of violation of this contract, Renter agrees that they will immediately vacate said premises without refund, when found to be in violation of this contract.

SIGNATURE: By My/Our Signature below, I/We state this agreement has been read in entirety, and Acknowledge this is a binding contract. Renter or Owner should seek advice of attorney if/where they see fit. Renter and Owner concur with all terms and conditions specified herein. Signed Rental Rules must be attached. BY YOUR SIGNATURE, YOU ARE AUTHORIZING US TO CHARGE YOUR CREDIT CARD FOR ANY EXCESSIVE CLEANING NEEDED, DAMAGES EXCEEDING INSURANCE COVERAGE, TRASH EXCEEDING THE RECEPTACLES, PET OR SMOKING POLICY VIOLATION CHARGES.

SMOKING IS NOT PERMITTED inside rental. Smoking is permitted outside with proper disposal of butts, (not to be left behind), There will be a $250 charge for evidence of smoking in the unit.

People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.

All of the units are privately owned, the owners are not responsible for ANY accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

Keep the property and all furnishings in good order. Do not rearrange furnishings.

PETS ARE NOT ALLOWED UNLESS rental is listed as a Pet Friendly property, pre-approval has been obtained from owner for all pets and Pet Addendum is attached to Rental Agreement. There will be a $300 charge for violation of this policy.


NO FIREWORKS, (Illegal in the state of New York).

No disturbance to neighbors, adjoining properties or general area. Quiet time is between the hours of 10 PM and 9 AM.

Fires are not permitted unless contract lists a fire pit location.

No cutting, trimming or breaking of trees, limbs or bushes.

DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER AND HUMAN WASTE. FEMININE PRODUCTS AND DIAPERS ARE NOT TO BE FLUSHED DOWN TOILET! There may be an odor in the water due to the mineral content of the well (if the Premises has one).

Dangerous or Potentially Dangerous Situations should be reported immediately Day or Night. Should such items not be reported, Renter will be held responsible in event of any mishap of any nature resultant to person(s) and/or property from non-reporting of said condition and will indemnify and hold Owner harmless.
